PolicySearchUSA is operated by Miami Private Investigations under FDACS A1800135.

These Terms of Service ("Terms") govern your access to and use of PolicySearchUSA's services. By submitting a search request, you agree to these Terms.

1. Permissible purpose required

All searches require a documented permissible purpose under one or more of: GLBA, DPPA, state insurance regulations, court order, retainer, or other lawful basis. You represent and warrant that your stated basis is accurate. False representation of permissible purpose is grounds for immediate termination of service and may be reported to law enforcement and state licensing authorities.

2. Eligible requestors

Services are offered to: licensed attorneys, claims adjusters, subrogation departments, insurance recovery professionals, court officers, and individuals represented by counsel of record. Direct individual requests outside this framework are not accepted.

3. No-find, no-fee guarantee (limited)

Standard plate-to-policy searches under the Vehicle & Auto tier — including hit-and-run identifications — carry a no-find, no-fee guarantee. If we cannot identify the at-fault carrier within the standard turnaround window, the flat fee is waived. This guarantee does NOT apply to: rush searches, Homeowners / Commercial Property / General Liability searches, or searches where the requestor provides incorrect or incomplete information.

4. Turnaround times

Stated turnaround times are estimates based on typical state database response. Actual turnaround may vary based on source availability, holiday schedules, and request complexity. After-hours requests are queued for next-business-day processing unless rush priority is selected.

5. Accuracy and limitations

We deliver search results based on the best available data from authoritative sources at the time of search. We do not guarantee that returned information remains current after delivery. We do not guarantee that every policy in existence will be found — a "no policy of record" result may indicate either (a) no policy exists or (b) the policy is held by a source we cannot access. We disclose source attribution in all results.

6. Use of returned data

Returned data may only be used for the permissible purpose disclosed in your request. Resale, redistribution, or use for purposes outside that scope is strictly prohibited. DPPA carries criminal fines under 18 U.S.C. §2723 and civil liability under §2724, including liquidated damages of not less than $2,500 per violation, plus attorneys' fees and punitive damages for willful violations.

7. Engagement and payment

Engagement is per-case or by retainer arrangement, scoped at intake. Per-case invoices are due net-15. Retainer arrangements are billed monthly in advance. We reserve the right to update engagement terms with 30-day notice to existing accounts.

8. Confidentiality

We treat all requests, returned data, and case-related information as confidential. We do not disclose client identities or search particulars to third parties except as required by law (court order, subpoena, or regulatory investigation).

9. Limitation of liability

PolicySearchUSA's liability is limited to the fees paid by the requestor for the specific search at issue. We are not liable for consequential, indirect, or punitive damages. Search results are informational and not legal advice. Authentication of returned documents for trial use remains a judicial determination under FRE 901/902; we provide chain-of-custody documentation to support authentication.

10. Indemnification

You agree to indemnify PolicySearchUSA against claims arising from misrepresentation of permissible purpose, misuse of returned data, or use of returned data outside the scope of the disclosed purpose.

11. Termination

We reserve the right to terminate service to any client who misrepresents permissible purpose, misuses returned data, or fails to pay invoices within terms.

12. Governing law

These Terms are governed by the laws of the State of Florida. Disputes will be resolved in the courts of Miami-Dade County, Florida.

13. Updates

We may update these Terms as needed. Existing requests are governed by the Terms in effect at the time of submission.
